Privacy Policy
Effective October 12, 2026
PEAK INDUSTRIAL, INC. / PEAK INDUSTRIAL PLAINS
This Privacy Policy describes how Peak Industrial, Inc., Peak Industrial Plains, and their participating affiliated businesses, including Peak Thermo King, Peak JCB, Peak Rents, and ATSR (“Company,” “we,” “us,” or “our”), collect, use, disclose, retain, and protect personal information in connection with their websites, customer inquiries, goods, services, and communications.
This policy applies to websites and communications programs that link to or reference it. The business responding to your inquiry or providing a communications program will be identified when you interact with us.
1. Information We Collect
Depending on your interactions with us, we may collect the following categories of information:
Contact information: Your name, business name, email address, telephone number, and mailing, billing, shipping, or service address.
Inquiry and transaction information: Equipment interests, quote requests, purchases, rentals, service requests, appointments, billing information, and related correspondence.
Equipment information: Equipment identifiers, specifications, and other details you provide for equipment sales, rentals, parts, or service.
Communications information: Messages you send us, communication preferences, consent records, and unsubscribe or withdrawal requests.
Website usage information: IP address, browser and device information, pages visited, referring pages, and interactions with website content, cookies, or similar technologies.
We collect information you provide directly, information generated through your use of our websites and communications, and information supplied by service providers involved in an interaction or transaction.
Please do not submit sensitive personal information through a general inquiry form unless specifically requested through an appropriate process.
2. How We Use Information
We may use personal information to:
Respond to inquiries and requests for information.
Prepare quotes and provide information about equipment, parts, services, and rentals.
Process transactions, arrange deliveries and rentals, schedule appointments, and perform service work.
Provide customer support and manage customer accounts.
Send communications you request or authorize.
Maintain communication preferences, consent records, and unsubscribe records.
Understand website usage and improve our websites and services.
Protect against fraud, unauthorized activity, and misuse.
Maintain business records, resolve disputes, and satisfy applicable legal obligations.
Marketing communications are subject to the consent and preference provisions below. Providing contact information does not, by itself, enroll you in SMS or email marketing.
3. Disclosure of Information
Subject to the mobile information and SMS consent protections in Section 4, we may disclose personal information:
To service providers: Businesses that support website hosting, customer management, communications delivery, payment processing, analytics, and other business operations.
To affiliated businesses: When reasonably necessary to respond to your inquiry or provide the goods or services you requested.
To transaction participants: Manufacturers, suppliers, transportation providers, or other parties when necessary to fulfill a request, delivery, service, or warranty matter.
For legal and protective purposes: When required by law, legal process, or a valid governmental request, or as legally permitted to protect rights, safety, property, and the integrity of our services.
In business transfers: In connection with a merger, acquisition, reorganization, or transfer of business assets, subject to applicable law and the communications protections in this policy.
At your direction: When you authorize or direct a disclosure.
These disclosures do not authorize another business to use your SMS consent for its own marketing.
4. Mobile Information and SMS Consent Protection
Mobile information will not be sold, rented, or shared with third parties or affiliates for their marketing or promotional purposes. SMS opt-in data and text messaging consent will not be sold, rented, or shared with third parties or affiliates for their marketing or promotional purposes.
We may disclose information to service providers solely as necessary to operate and support our messaging programs, including message delivery, customer support, and consent management. These providers are subject to appropriate confidentiality and use restrictions.
The general disclosure provisions elsewhere in this policy do not override these protections. Any legally required disclosure will be limited to what the law requires.
5. SMS and MMS Communications
We send SMS and MMS messages only after obtaining the consent required for the applicable program and message type. Enrollment identifies the sending business and the purposes of the program.
Depending on your selected program, messages may include inquiry responses, quotes, appointment reminders, service updates, order and rental notifications, and separately authorized promotional communications.
Messages may be sent using automated technology. Marketing text messages require separate, express written consent.
Consent is voluntary and is not a condition of purchasing goods or services. Providing your telephone number, submitting a form, purchasing goods or services, or accepting our Terms and Conditions does not, by itself, constitute consent to receive marketing text messages.
Message frequency varies. Message and data rates may apply.
You may unsubscribe at any time by replying STOP to a message. We also honor other reasonable requests to withdraw consent. You may receive one nonmarketing message confirming your opt-out. Further messages from that program will stop unless you provide new consent.
For assistance, reply HELP, call (801) 363-1963, or submit a request through our contact form:
https://www.peakthermoking.com/contact-form
We maintain records of consent and withdrawal requests. SMS consent applies only to the business and purposes identified at enrollment and does not automatically authorize marketing emails or marketing telephone calls.
Please notify us if your mobile number changes or is reassigned so we can update your communications preferences.
6. Email Communications
We may send emails concerning inquiries, quotes, purchases, rentals, appointments, service requests, invoices, and account activity.
Marketing emails, including newsletters, promotional offers, and product announcements, are sent to individuals who separately opt in to the identified business’s email marketing program.
Marketing email consent is voluntary and is not a condition of purchasing goods or services. Providing an email address or accepting our Terms and Conditions does not, by itself, constitute consent to receive marketing emails.
You may unsubscribe using the unsubscribe link included in each marketing email. You may also request removal by calling (801) 363-1963, submitting a request through our contact form, or mailing a request to the address in Section 13.

We honor marketing email opt-out requests within ten (10) business days, or sooner where required.
Unsubscribing from marketing emails does not prevent necessary transactional or relationship emails permitted by applicable law, including communications concerning an existing inquiry, order, rental, service request, invoice, or account.
Marketing emails identify the sender and include a valid physical mailing address and a functioning unsubscribe mechanism.
Email marketing consent does not automatically authorize SMS or marketing telephone calls.
7. Cookies and Similar Technologies
Our websites may use cookies, pixels, and similar technologies for website functionality, security, analytics, and advertising measurement. These technologies may collect device identifiers and information about website activity.
You can manage cookies through your browser settings and any consent or preference controls provided on the website. Restricting certain cookies may affect website functionality.
Where applicable law requires consent for particular technologies, we will obtain that consent. Where applicable law requires recognition of browser-based opt-out preference signals, including Global Privacy Control, we will honor those signals.
Website tracking choices are separate from SMS and email enrollment. Accepting cookies does not constitute consent to receive marketing text messages or marketing emails.
8. Information Retention
We retain personal information for as long as reasonably necessary for the purposes described in this policy, including customer service, transaction management, recordkeeping, dispute resolution, and legal compliance.
Retention periods depend on the information involved, the customer relationship, and applicable requirements.
We may retain limited consent and unsubscribe records after an opt-out request to document the request and prevent further unauthorized marketing communications.
9. Information Security
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, use, disclosure, alteration, or destruction.
No website, electronic transmission, or storage system can be guaranteed completely secure.
10. Your Choices and Privacy Rights
You may contact us to request access to, correction of, or deletion of personal information associated with you.
Depending on your location and applicable law, you may also have rights to:
Obtain a copy of your personal information.
Opt out of certain processing, including targeted advertising or legally defined sale or sharing.
Withdraw consent where processing is based on consent.
Appeal a decision concerning a privacy request.
These rights are subject to applicable legal exceptions. We may need to verify your identity before fulfilling a request. Where applicable, an authorized agent may submit a request on your behalf.
We will process requests and any available appeals within the periods required by applicable law. We will not unlawfully discriminate against you for exercising privacy rights.
Submit requests or appeals using the contact information in Section 13. SMS and email unsubscribe instructions are provided in Sections 5 and 6.
11. Children’s Privacy
Our websites and communications programs are intended for business customers and adults and are not directed to children under thirteen (13).
We do not knowingly collect personal information from children under thirteen. If you believe a child has provided personal information to us, contact us so we can review the matter and take appropriate action.
12. Third Party Websites and Policy Changes
Our websites may link to third party websites or services. Their handling of personal information is governed by their own privacy policies.
We may update this Privacy Policy to reflect changes in our practices or applicable requirements. The effective date identifies when the current version takes effect.
We will provide additional notice or obtain consent when required by applicable law. Changes to this policy do not automatically expand SMS or email marketing consent previously provided.
